1. Who may use the Services

• You must be 18 years or older to use Kyndr Stay.
• You confirm that you have the authority to create accounts, manage properties, and share content.

2. The Services

Kyndr Stay provides:

• Digital property guides
• Public guest access via links or QR codes
• An AI-powered concierge that answers questions using host-provided content

Guests do not need accounts to access guides.

3. AI concierge disclaimer (important)

• The AI concierge provides informational guidance only.
• It relies entirely on content entered by the host.
• It does not provide professional, legal, safety, or emergency advice.

Hosts are solely responsible for the accuracy, completeness, and legality of their content.

Guests should contact the host directly for urgent, safety-critical, or emergency matters.

4. Host responsibilities

• All content you upload must be accurate, lawful, and appropriate.
• You must have the right to upload and share the content.
• You’re responsible for keeping information up to date.
• You acknowledge that guests may rely on your content.

5. Public links and QR codes

• Guest access links and QR codes remain valid until you rotate or revoke them.
• You are responsible for sharing and managing those links.
• Kyndr Stay is not responsible for unauthorised sharing or failure to rotate exposed links.

6. Content ownership

Hosts retain ownership of all content they upload.

By using Kyndr Stay, hosts grant us a limited, non-exclusive licence to store, process, and display that content solely to operate the Services.

7. Subscriptions and payments

• Paid plans are billed on a recurring monthly basis via Stripe.
• Fees are non-refundable except where required by law.
• We may change pricing or plans with reasonable notice.
• Failure to pay may result in suspension or downgrade.

8. Acceptable use

You must not:

• Misuse or abuse the Services
• Attempt to bypass limits or security controls
• Upload unlawful, misleading, or infringing content
• Interfere with the operation of the platform

We may suspend or terminate access for violations.

9. Availability and changes

We aim for high availability but do not guarantee uninterrupted access.

Features may change, be suspended, or discontinued at any time.

10. Limitation of liability

• The Services are provided “as is”.
• We’re not liable for indirect, incidental, or consequential losses.
• We’re not responsible for reliance on AI responses or host-provided content.

Nothing limits rights that cannot be excluded under Australian Consumer Law.

11. Indemnity

You agree to indemnify and hold us harmless from claims arising from the content you upload, your use of the Services, or your breach of these Terms.

12. Governing law

These Terms are governed by the laws of Victoria, Australia.

You submit to the exclusive jurisdiction of the courts of Victoria.
